In short: if you receive contributory unemployment benefit and want to become an autónomo, there are two routes that cannot be combined for the same start. The lump-sum payment (pago único, also called capitalización) gives you what you have left in one go to invest, and you request it from SEPE before registering with Social Security. The other route is to keep your unemployment benefit as an autónomo: you keep receiving it for up to 270 days after registering if you ask within 15 days of starting. Both work at any age, but not for the unemployment subsidy (subsidio). First you must be entitled to the benefit: at least 360 days of contributions in 6 years and losing your job without quitting.

In person or by representative? Mixed. The pago único is requested at the SEPE electronic office, procedure SV0503, with Cl@ve or a certificate, or at the benefits office with a SEPE appointment, or at any public registry. To combine both you use the contributory benefit application form, ticking «Compatibilidad con trabajo por cuenta propia», through the same channels. The sources we reviewed do not detail filing through a representative. In the Valencian Community the benefit is handled by SEPE; LABORA only handles job seeker registration.

First: are you entitled to unemployment benefit?

Both routes only exist if you receive the contributory unemployment benefit; the subsidy (subsidio) does not count. To get it you need at least 360 days of contributions in the previous 6 years, to lose your job without quitting, and to register as a job seeker and apply to SEPE within 15 working days. Voluntary resignation gives no benefit, so quitting to start a business does not work (General Social Security Law, art. 267.2.a). Requirements, duration and amounts are in the card on unemployment benefit in Spain for foreigners.

Example (illustration, not a SEPE calculation). With 3 years worked and an average base of €1,500 a month you get 360 days of benefit, about €11,700 gross. If you request the pago único after receiving 2 months, about €9,600 is left, and SEPE pays somewhat less because it deducts the legal interest rate.

The full path, from losing your job to becoming an autónomo

  1. You lose your job without quitting: dismissal, end of a temporary contract or another legal unemployment situation.
  2. Within the next 15 working days you register as a job seeker (LABORA in the Valencian Community) and apply to SEPE for the benefit. You can request the pago único in the same application or later, as long as you have at least 3 months left and have not started the activity (SEPE).
  3. In your SEPE personal area you check that it is the contributory benefit and how many days you have left.
  4. You choose between the pago único (route A) and benefit and self-employment together (route B).
  5. Route A: you request the pago único before any registration and, to be safe, wait for the decision. Then you register with the tax agency using form 036 and in the RETA, requesting the flat rate in the registration itself (becoming an autónomo as a foreigner).
  6. Route A: you invest the money and justify it in the month after payment; if you keep the activity for 5 years, you pay no IRPF on it.
  7. Route B: you register as an autónomo and, within 15 days of starting, ask SEPE for the compatibility.

If you are a foreigner: does your permit let you work for yourself? SEPE treats resident foreigners like Spaniards, and for the pago único it asks for a valid TIE with a photo. If your TIE has expired and you applied for renewal on time, your permit remains valid (for example, Royal Decree 1155/2024, art. 80.1); whether SEPE accepts the renewal receipt instead of the TIE is being confirmed with SEPE. But both routes mean working legally as an autónomo, and that depends on your permit:

  • Temporary protection: yes. The Ucrania Urgente website of the Ministry of Inclusion says it allows self-employment or employment, as does Directive 2001/55/EC (art. 12). With 360 days of contributions, the benefit follows the same rules as for anyone.
  • Arraigo and other permits for exceptional circumstances: yes, except the socioformativo arraigo, which only allows employment (Royal Decree 1155/2024, art. 131).
  • Renewed residence and work permit as an employee, long-term residence or family member of an EU citizen: yes (arts. 81.1 and 182 of Royal Decree 1155/2024; Royal Decree 240/2007, art. 3.2).
  • First permit as an employee (the first year): only as a secondary activity. The exception is when your job ended for reasons beyond your control and you inform the immigration office (Extranjería) within 3 days (art. 73.5); you can also apply to switch to self-employment (art. 192.2). Whether informing them is enough and how it is renewed afterwards are open questions for Extranjería.
  • Without a residence and work permit you cannot receive unemployment benefit (Organic Law 4/2000, art. 36.5).

Route A: lump sum (pago único)

  • Who: you receive the contributory benefit, not the subsidy, and you have at least 3 months left. You did not receive the pago único in the previous 4 years and, to become an autónomo, you did not combine benefit and self-employment in the previous 24 months. It also does not apply if you will be an economically dependent autónomo with a contract with your last company. If you challenged the dismissal, you apply after that procedure is resolved.
  • How much: up to 100% of the remaining benefit, limited to the investment you justify, minus the legal interest rate (3.25% in 2026). Up to 15% can go to advice, training and information. You can take it all at once, as a monthly refund of the autónomo contribution, or combine both; the option is chosen when you apply.
  • What it can be spent on: equipment, furniture, stock, the rental deposit, business transfer (traspaso), franchise, website and licences. Start-up fees and taxes and the costs of the first 3 months, such as rent, also count, according to the SEPE project report template.
  • The order: SEPE compares your application date with the date of your Social Security registration, not the tax registration, and refuses it if you were already registered as an autónomo. After applying, you may register before the decision. The safest option is to make no registration at all, at Social Security or the tax agency, until you have applied.
  • After payment: you start the activity within 1 month at most; SEPE sometimes counts it from the decision and sometimes from the payment, so count from the decision. In the month after payment you justify 100% with bank payments (justification, SEPE).
  • Response time: if there is no answer within 3 months, the application counts as refused.

How the money is used (route A)

  • Purchases made before applying for the pago único do not count, nor do cash payments.
  • If you do not start the activity, do not invest the money or use it for something else, SEPE claims back everything paid.
  • Income tax (IRPF): the pago único is exempt if you keep the activity for 5 years (IRPF Law, art. 7.n). If you close earlier, you include it in the tax return for the year of closure, with late-payment interest.
  • After receiving it you cannot claim new unemployment benefit until the period it covered has passed, nor another pago único for 4 years.
  • Flat rate (tarifa plana): it is compatible and is requested in the registration itself (€88.64 flat rate). How much SEPE refunds each month if you choose the contribution refund and have the flat rate is being confirmed with SEPE.

Route B: benefit and self-employment together (compatibilidad)

  • Who: you receive the contributory benefit after losing your job completely and you register as an autónomo. There is no age limit.
  • Deadline: you ask SEPE within 15 days of starting the activity; after that, it is no longer possible. The rule does not say whether these are working or calendar days (being confirmed with SEPE): count calendar days to be safe.
  • What you receive: 100% of the benefit, with IRPF withholding if applicable and without deducting contributions, for up to 270 days or whatever you have left. You pay the autónomo contribution yourself; the law does not exclude the flat rate. This benefit is taxed.
  • Not eligible: people whose last job was self-employed; people who combined both or received the pago único in the previous 24 months; people who sign a contract to provide services to their last company or its group. According to SEPE, also not people joining a company as a partner or joining an existing cooperative or worker-owned company.
  • It ends if you start working as an employee. After 270 days, any remaining benefit is suspended; if you close the activity within 60 months of registering, you can ask for it to resume.
  • The employment support supplement (complemento de apoyo al empleo, CAE), which lets you keep part of the benefit while working, is only for employees, not for autónomos.

And with temporary protection? You can work for yourself, but SEPE has not published a position of its own on the pago único or the compatibility for this status; we are confirming it. Your TIE is valid until 4 March 2027 (Order INT/96/2026) and the protection lasts until 4 March 2028. Sometimes the 270 days of route B go beyond 4 March 2027: what happens then is being confirmed with SEPE. The 5 years of the IRPF exemption go beyond 2028: that is a question for the tax agency.

What to do now

  • In your SEPE personal area, check that you receive the contributory benefit and how many days you have left.
  • Do not register as an autónomo, not even with the tax agency, until you have chosen the route.
  • Check that your permit lets you work for yourself.
  • For the pago único, ask now for quotes or proforma invoices in your name.
  • The rest of the registration is in the card on becoming an autónomo as a foreigner.

Documents (route A)

  • The pago único application form.
  • A valid TIE with a photo (non-EU) or the EU citizen registration certificate with the NIE and a passport or ID document.
  • Report on the project and the investment (if you only ask for the contribution refund, without detailing the investment).
  • Any document showing the project is viable, such as quotes or proforma invoices.
  • For route B: the contributory benefit application form with the compatibility box ticked.

Steps

  1. Check with SEPE your type of benefit and the days left, and that your permit allows self-employment.
  2. Choose the route: pago único before registering, or compatibility after registering.
  3. If you choose the pago único, file the application with the report and keep the dated receipt.
  4. After applying, register with the tax agency and Social Security, request the flat rate and justify the investment in the month after payment.
  5. If you choose the compatibility, register and ask SEPE for it within the following 15 days, counting calendar days.

Frequently asked questions

What is the lump-sum payment of unemployment benefit for autónomos?

It is the pago único: SEPE pays you the remaining contributory benefit in one go to invest in your activity, minus the legal interest rate. You must request it before registering with Social Security, have at least 3 months left and not have received it in the previous 4 years.

Can I receive unemployment benefit as an autónomo at the same time?

Yes, for up to 270 days or whatever contributory benefit you have left, if you ask SEPE within 15 days of starting the activity. You receive 100% of the benefit and pay the autónomo contribution yourself. It does not apply if your last job was self-employed.

Can I request the pago único as a foreigner or with temporary protection?

Yes, on the same terms, but your permit must allow self-employment and SEPE asks for a valid TIE. Temporary protection allows it; SEPE has no published position of its own on it and we are confirming it.

Do I pay income tax (IRPF) on the pago único?

No, if you keep the activity for 5 years. If you close earlier, you must include it in the income tax return for the year you close, with late-payment interest. Benefit received together with the registration is taxed.

Can I quit my job and take my unemployment benefit as a lump sum to start a business?

No. Voluntary resignation is not a legal unemployment situation and gives no right to benefit (art. 267.2.a of the General Social Security Law), so there is nothing to take as a lump sum. You need to lose your job through dismissal, the end of a contract or another cause the law recognises, and have at least 360 days of contributions in the previous 6 years.
