In short: A power of attorney at the Honduras consulate in Madrid comes in three types: Carta Poder (USD 50, valid 6 months, one institution only), General Power (USD 150, broad powers) and Special Power (USD 200, one specific act). For the procedures of a person under 21 there is also the authorization (USD 50). All need a free appointment and your personal attendance.
In person or by representative? In person only: nobody else can do it for you. You must bring your physical, valid Honduran DNI. For a Carta Poder or a Power you cannot enroll for the DNI on the day; for the minors' authorization you can (see below).
Which document you need
- Carta Poder (USD 50): administrative matters at a single institution, such as a bank. Valid 6 months from issue. It does not cover buying, selling, divorce, court proceedings or representing a minor.
- General Power (USD 150): broad powers for several matters: managing property, opening bank accounts, inheritances, filing lawsuits or court proceedings, representing a minor or custody.
- Special Power (USD 200): limited to one specific act, such as selling an asset, one bank procedure, one court case or custody of a minor.
- Authorization for minors (USD 50): issued for the procedure you name and valid 6 months. One or both parents, guardians or legal representatives of a person under 21 can request it. The Consulate lists these common uses: the minor's passport, international travel, marriage of someone aged 18 to 21, visas, Spanish residence or nationality and other procedures at the Spanish Embassy in Honduras. It gives no representation or custody of the minor: only a General or Special Power does.
Prices are per document. You pay on the day of the appointment by credit or debit card at the Consulate, or in cash by deposit at an ATM; the euro exchange amount is given that day. The Consulate says the legal documents section is open Monday to Friday, 9:00 to 13:00, by appointment.
Documents
For all three powers:
- Appointment for the chosen type of power (free, see how to book).
- Physical, valid Honduran DNI.
- Details of the person receiving the power: photocopy of their DNI and their address. If a lawyer: full name, DNI copy and bar membership card copy.
Carta Poder only:
- Name of the institution where it will be presented. For a bank, a copy of the passbook with the account number.
General Power and Special Power only:
- Full name, marital status, profession and address of the attorney.
- Draft of the power written by a lawyer or notary in Honduras, emailed to [email protected] before the appointment.
- Case-specific information, for example birth certificates of minors (custody) or the cadastral key and land details (property sale).
Authorization for minors only:
- Appointment for an Authorization.
- Physical, valid Honduran DNI (if one parent is a foreigner, their valid passport).
- Copy of the Honduran DNI of the authorized person (a copy of the passport if foreign).
- Copy of the birth certificate of each minor; a copy of their passport also works.
- If the procedures will take place in Honduras, the authorized person must hold a valid Honduran DNI.
- No physical DNI: if you lost it or left it in Honduras, you request a replacement at the Consulate on the day (USD 25). If you never applied, you enroll that day with your valid Honduran passport (free the first time).
Powers and authorizations from the Consulate that you will use in Honduras need the SRECI authentication (auténtica): see the guide on authentication of consular documents. If you will use the authorization for a minor's passport, see also the guide on the Honduran passport in Madrid.
The Consulate states that the applicant is responsible for a correct model: a draft that does not match the type of power is returned, and any cost of the error is yours. If a document is missing, you will not be served.
Steps:
- Choose the document that fits what you need to do.
- Book the free appointment on the Consulate's official site.
- For a General or Special Power, get a draft from a lawyer or notary in Honduras and email it.
- Gather the documents and attend on the day and time of the appointment.
- At the appointment, for a General or Special Power, the whole document is read to you for review before you sign and seal it; then you pay.
- If you will use it in Honduras, request the SRECI authentication.
