In short: The Supreme Court denies Ceuta interim measures in the appeal the Autonomous City filed against the central Government. Ceuta says the State is not providing the means to process on time the expulsions, returns and asylum applications that followed the mass entry of 30 and 31 July 2026. The court has not ruled on the substance yet: it will first hear the State, which has 10 days to reply.
What changes for you today
Nothing. This is a dispute between the City of Ceuta and the State, and it changes no procedure or deadline for migrants. How Ceuta's special regime works is in the guide Ceuta, national security and migrants: RD 681/2026, and how to apply for asylum is in How to apply for international protection (asylum) in Spain.
What happened
The Supreme Court's Administrative Chamber rejected the most urgent interim measures (known in Spanish as medidas cautelarísimas) that Ceuta asked for. An interim measure is a provisional order while the appeal is decided. The most urgent kind is requested so that the court issues it without first hearing the other side. The court reasons that this needs special urgency, and it does not see it: according to the release, Ceuta itself admits that the inaction it reports has lasted over two and a half months without any request for interim protection.
The appeal is against the inaction of the central State administration in assigning and deploying the staff and resources needed to process on time the expulsion or return procedures and the international protection procedures left by the entry of 30 and 31 July.
How it works now
Ceuta is in a situation of interest for National Security until 31 December 2026 (RD 681/2026), a regime that coordinates State and City resources, and temporary reception was extended by RD 761/2026. This order does not touch any of that.
What would change
The order changes nothing by itself. The court has decided neither the ordinary interim measures nor the substance of the appeal. The judiciary's release does not detail which specific measures Ceuta asks for.
What happens next
The court will handle the interim-measures request through the ordinary procedure and give the State Legal Service (the lawyers who defend the State) 10 days to reply. Separately, the court asks the Ministry of the Presidency, Justice and Relations with the Cortes to send the administrative file within 20 days. No decision date has been given.
What you can do
- Nothing because of this decision.
- If you have an expulsion, return or asylum decision in progress, check the deadlines in it: appeal an immigration refusal. Talk to a lawyer or to the free legal aid service (turno de oficio), if you meet the requirements.
