In short: The EU return regulation was published in the Official Journal (DOUE) on 15 October 2026. It is the EU rule for returning third-country nationals who are in an irregular situation, and it replaces Directive 2008/115/EC. Almost all of its rules apply from 17 October 2027, so nothing changes today.
What changes for you today
Nothing. The current rules apply until 17 October 2027. If you have a procedure in progress, carry on as before: appeals against denials, voluntary return from Spain. What the regulation says is in the guide EU Regulation 2026/2280 on return.
What happened
The European Parliament and the Council approved the regulation on 7 October 2026 and the Official Journal of the EU published it on 15 October. An EU regulation, unlike a directive, applies directly in the Member States: no Spanish law is needed to transpose it. It enters into force on 16 October 2026, the day after publication, but only a few provisions apply from that date (including those on minors and agreements with third countries).
This rule is one piece of the EU migration reform. The European Commission already mentioned it when talking about returns in its 29 September plan, which we cover in European Commission plan against mass arrivals. What is new now is that the text is approved and published.
How it works now
Directive 2008/115/EC applies, and each country implements it with its own law. In Spain that is the immigration law. We have not checked in our guides the detail of how each rule below works today, so we do not compare them one by one.
What would change
From 17 October 2027, according to the text of the regulation:
- A written return decision with a departure period of up to 30 days, or immediate departure.
- Entry ban of up to 10 years, and up to 20 in justified cases.
- Detention of up to 12 months, extendable to 24, after an individual assessment.
- A single European form for the return order, which countries can register in the Schengen Information System.
- Recognition between countries of return decisions, without a new administrative procedure.
- Duty to offer advice and voluntary return programmes, without the aid being an individual right.
- Directives 2008/115/EC and 2001/40/EC and Decision 2004/191/EC are repealed.
The regulation does not say how Spain will adapt its immigration law. That is not yet known.
What happens next
On 17 April 2027 the Commission must adopt the form of the European return order. On 17 October 2027 almost everything else starts to apply. On 17 October 2029 the Commission will assess mutual recognition of decisions and may propose binding rules.
What you can do
- If you have no return decision or departure order, you do not need to do anything because of this regulation.
- If you have a decision in progress, talk to an immigration lawyer and respect the deadlines in it; this rule does not change them today.
- If you are thinking of going back to your country, the guide voluntary return from Spain explains who to contact today.
